Personal Banking. In the personal banking segment one of the principal products and services include deposit products. The Bank of China provides a variety of deposit products including foreign currency deposits. It has also included multifunctional debit card which can assist financial planning. (Deposits, 2006). It has also got a facility for deposit collections at different places which facilitate those with transferable jobs or changing residences frequently to follow up their deposits without any geographical constraints (Deposits, 2006). Deposit Certificates are being issued by the Bank for people’s needs for studying abroad, visiting relatives or for domestic requirements. (Deposits, 2006). The bank also provides facilities for payment of fees, providing pay to employees, stock fund transfer service and handling of securities trading services. (Deposits, 2006). In addition Personal Checks are provided for high value account holders for making large purchases which are beyond the credit card limits allotted. (Personal Check, 2006). In the loans segment, Bank of China is providing a variety of loans to its personal customers. The primary loans include educational loans which can be commercial or state. The latter are at discounted interests by the central financial authorities in China, while commercial loans are for financing tuition and other fees which is supported privately. (Loans, 2006). Auto loans include financing for purchase of cars. In addition there are travel loans to facilitate in board as well as out board travel which however has to be only through approved travel company services as per bank norms. (Loans, 2006). There are petty consumer credit loans which are provided for facilitating normal consumption needs of customers such as labor service and fee payments. (Loans, 2006). For such purposes the client is required to be credit worthy. A normal service provided by the Bank is renting of safe deposit box. (Loans, 2006). Another important service provided by the bank is that of Bancassurance, which involves a tie up with the insurance companies, providing the client a full range of services to include insurance, premiums on policy and preservation at a savings outlet in BOC. (Bancassurance, 2006). Corporate Banking. In the corporate banking sector, the Bank of China has a strong presence with a global profile. Its experience and expertise is seen to be of particular benefit to the Chinese businessman seeking to do business globally. (Corporate, 2006) The bank claims to provide unique services based on its ability to assess market sensitivity. The various corporate services provided by the bank include financing for trade, risk controls, protection of risk of debt and is extending even further to management of ledger and collection. (Corporate, 2006). In the loans segment the various types of loans include providing working capital to the companies, for financing projects, real estate businesses, fixed assets and loans on foreign currency. (Corporate, 2006) Business is provided finance in various forms of credit such as a normal credit line, credit for export buyers, finance lease guarantees, credit for export sellers, accounts receivable purchases and labor service contracts. (Corporate, 2006). For international businesses, the services provided include both inward and outward remittance, collection of letters of credit for both imports and exports, bill discounting, packing loan and guarantees for businesses and shipping. (Corporate, 2006). The investment banking services include a financial advisory service, cash management, loan trusts and agent bank business. The bank has also developed extensive e banking services to include i-banking, telephone banking and mobile phone banking. These services are seen to be highly effective in providing the corporate a variety of mediums of interaction on the World Wide Web. (Corporate, 2006). In the segment of foreign exchange and settlement, it is the lead bank in China and hence enjoys considerable leverage in the Chinese banking industry. This caters for individual and personal foreign exchange needs. (Forex, 2006). It has also facilities for forward transactions in foreign exchange Global business facilities include same day facility of funds transfer with the GLOBAL NICS programme in place which enables transactions across 581 overseas branches in 26 countries and regions on a single computer network. (Global, 2006). Linked to SWIFT communications, it enables a safe and speedy transaction for business persons. This is particularly significant with the extensive network of the Bank within China comprising of over 12,000 branches. It also facilitates international clients to transfer money within China speedily. (Global, 2006). Overseas Presence. The Banks overseas presence has been consistently growing after the China Development Finance Company (HK) was established in 1979, followed by Bank of China Groups Securities Limited in 1983, Bank of China International UK Ltd 1996 and Bank of China International in Hong Kong in 1998. (BOCI, 2006). The subsequent entry of BOCI into mainland has provided it added opportunity to establish close links with stable Chinese corporations to include China National Petroleum Corporation, State Development & Investment Corporation, China General Technology (Group) Holdings Limited and so on. (BOCI, 2006) This enables strengthening of the financial link of the Bank providing it greater stability in the international as well as national banking domains. (BOCI, 2006). Banking Facilitation. The BOC is also an agent bank for a large number of other banks providing them the services of consignment banking to manage loans between borrowers and the agent bank. The consignment banks include China Import and Export Bank and the State Development Bank. (Agent, 2006). This provides the client bank the advantage of drawing upon the experience, expertise and network of a larger bank with an international presence as the BOC. A relatively high quality of service is said to be provided to the agent bank by BOC. Generally a tripartite agreement is signed between the BOC, the client bank and the borrower. (Agent, 2006).

Briefly Describe The Long March and explain why it is an important event in Chinese History

In the summer of 1934, after suffering a string of defeats, the communist party and the Read Army decided to flee their southern bases and retreat. This retreat became known as the Long march. On the march the group endured 368 days of extreme hardship before they finally reached the caves of Yenan in Northern China. The Long March is recalled fondly with great idealism as a time when thousands of Chinese peasants selflessly volunteered to join the fight. The Long March is considered an important event in Chinese history for many reasons. It was very important for the CCP and Red army because communism survived and they found a new base.This new base was remote enough for the GMD to be unable to attack it, and was also safe from attack by the Japanese. This helped to increase the CCP’s standing in China even further. Another key impact of the Long March was that Moa Zedong was re-established as the unchallenged leader of the CCP. The cowardliness of his guerrilla tactics durin g the extermination campaigns had meant that he was replaced for a short time by Otto Braun. However Braun allowed the communists to carry too much equipment, and led the retreat in a straight line, making them slower and easier to attack.He was blamed for their huge losses, and leadership was soon handed back to Mao. After the success of the march, his tactics were forgotten and he was hailed as a great hero. The march also allowed many Chinese people to see the CCP as great heroes, and therefore increased support for them. The long march became part of Chinese Communist mythology. Many paintings were produced showing Mao marching at the head of the column over the mountains of Western China. This opinion really boosted support for communism and many people began to agree with their policies over those of Chaing’s and the GMD’s.During the Long March, Support for Communism was also increased by the good behaviour of the Red Army in the provinces they crossed. Their pos itive attitudes and fair morals impressed many local people, especially peasants, who were more inclined to support the CCP. Their rules to speak politely, pay fairly, not to hit or swear, not to take liberties with woman and not to ill-treat prisoners greatly contrasted with the brutal and cruel treatment of the locals by the GMD armies, who captured, starved and murdered anyone who had any connection to communism.The Long march was not at all as idealistic as it seemed in reality, thousands of communists were wounded, killed, starved or froze to death. However, today it is not seen as a failure for the CCP, but is instead hailed as an important event in the survival and establishment of the communist government, leadership and support in China and a key event in Chinese History.

Even in schools where African-America children were enrolled, the children were subjected to taunts of racial epithets. Moreover, such schools were under the mercy of the state government, which was controlled by whites. Most whites did not want education for African-Americans due to the fear that they would become a threat to their dominance and fail to be content with jobs in domestic services and fields (Washington 44). Although William Dubois and Booker T Washington were born and raised in the Northern part of the USA, which was tolerant and liberal towards African –Americans than the south, they had different ideas on how to help the African-Americans from prejudice faced under the white majority.

Consequently, people are deprived of the potential education offers for the overall development of personality and stability of society. The chaos in modern world is also partly due to this fault. Therefore, in order to meet the multi-dimensional challenges, man faces in the world, it is essential to impart real education i. e. liberal education. The liberal education has been defined in many ways, though emphasizing the similar essential elements. The best definition is offered by the â€Å"Association of American Colleges and Universities†. â€Å"Liberal education means to empower an individual and prepare him to deal with diversity, complexity and change†. As manifest from the definition, the purpose of education is to enable man to surpass the challenges faced in the world, to know and obtain his rights and to accommodate himself in the constantly changing environment in the present day competitive world. The importance of liberal education in this contemporary globalised world is greatest than ever before. The world has become so shaped that every economic and social activity requires modern and advanced means of communication and technology. The transformation of technological development is on a very fast track. There is a demand of more interactive and communica tive manpower to run this complex system. Moreover, despite the interdependence on each other, the diversity in different areas is in sharp contrast. Hence, the man is required to be quite sufficiently prepared to move forward. And the instrument that can enable him to face these challenges is nothing but liberal education. This is why the renowned scholar â€Å"Skarnovey† says: â€Å"Liberal education: the developing countries must adopt it as it is a necessity†. Nevertheless, it is essential for every nation but the developed countries are already ahead in this sphere. The developing countries, which are still far behind, need to forge efforts to transform their education system in order to catch up with the rest of the world. Not only because it helps in achieving economic development but also because it fulfills the need of society in every sphere of life. The sphere of liberal education is wide enough to call it real education. Basically, education is aimed to develop whole being of a person. It is necessary to educate man to learn social ethics, cultural values, religious obligations, ways and means of a stable society and skills of professional competitiveness. Liberal education, simply, fulfills all these essential needs. It emphasises the development of a citizen who is professionally capable of living in the society in civilised way the way which is not only beneficial to himself alone, but also fruitful for other members of his family, community and society. It is best elaborated in the words of Kurth Kahin; â€Å"Liberal education teaches something about everything and everything about something†. His words can be best understood by contrast to the maxim â€Å"Jack of all; master of none†. Simultaneously, there are also people who are â€Å"Jack of none but master of one†. The people, who acquire general education without proficiency in any specific subject, are explained by the first maxim. While some people who are very skilled and highly qualified in one field like an engineer, scientist or doctor but do not know any other subject or field of life; these are referred to the latter assumption. However, liberal education is a moderate way between both the polar positions. It is aimed at making a person a good professional in any one field and also to possess knowledge and skills about other important fields. More importantly, it makes constructive members of society better described as â€Å"Jack of all; master of one†. In such a way, the objectives of liberal education are multifaceted, which address the requirement of society to a considerable extent. These objectives are briefly discussed here: Firstly, it is the most important for a man to be an informed citizen. The people who are concerned only with their single professional field of occupation cannot be ideally good citizens. They would only be members and nationals of a community or nation. A good citizen is required to be participatory in the social and political building of community, which is the foundation of any society. As the actions of man are based on information and knowledge, without these none understands the obligation towards community and resultantly remains inactive member of society. However, but if the students are inculcated the knowledge of their needs and roles, they would be quite prepared to foresee occurrences and would direct their thoughts and actions towards social and political participation. This can be achieved when the system of education is made liberal which does not aspire to produce only technical robots in human shape but informed and good citizens. Secondly, the philosophy of liberal education envisages the development of creative thinking among the students. Creative thinking has acquired fundamental place in the education system of advanced countries. The students are encouraged to â€Å"think a new†. The creative experiments, creative writings and creative art lead to frame the development of thought process. Though, it is practised in western countries, it owes its origin to the most influential scholars and artists of Greek period and early Muslim era. Socrates, Plato, Aristotle, Machiavelli, Ibn-e-Khaldun, Galileo, Khuw-arzmi, Newton, to name a few, all were creative thinkers. In short, whole of the development in the world and education itself is the result of creative thinking. On the contrary, the limited application of education is insufficient to produce brilliant minds. The specific technological development devoid of human values and ethics has failed to form the basis of a viable society. Thus, it is the objective of liberal education to teach the students various subjects like history, sociology, philosophy and psychology besides their professional field, so that creative thought is encouraged to be developed among them. Therefore, we need to introduce liberal education in order to secure our future based on collective ideals. Thirdly, liberal education improves the skills and competitiveness of students, which is necessary to enable them to get foothold in the competitive market. For example a typist may have good efficiency in his field but computers have replaced typewriter. People like to get their papers typed on computer in order to save their document and to get good command. Now, the excellent typist is in trouble, he would go jobless in the market unless he learns to operate computer. Same is the case with every field of employment. The modes of technology are being transformed very rapidly. In order to meet the demands of market one should be quite prepared and skilled. Hence, the knowledge of mathematics, science, computer literacy and technological acquaintance are necessary to be imparted to the students, which can be achieved through liberal education. Fourthly, as the world has become a global village, the importance of communication skills has been increased manifold. A person must be proficient in national and at least one international language. He must know how to send e-mail, voice-mail or to carryout visual communication. The social change compels the person to change the job for better opportunities. The talented people feel an urge to move towards other countries as well in order to actualise their talent and to obtain maximum result. This is where the communication skills are mostly required. All the communication techniques, basically, listening, speaking and writing are essential ingredients. Therefore, it is necessary to improve the skills of students through methods of listening comprehension and speaking ability tests. All the examinations of foreign languages comprise these elements and even very talented students from developing countries fail to go abroad due to lack of these communication skills in international languages. The world has become so shaped that every economic and social activity requires modern and advanced means of communication and technology. The transformation of technological development is on a very fast track. These few objectives of liberal education underline its importance and need in the developing countries, including Pakistan. Unfortunately, it has not been taken seriously. The system of education in our country is obsolete. It is devoid of the contemporary methodology of teaching and the curriculum is almost from primary to university level. Computer is studied as a field of study only, not as a skill. Even in most of the universities it is taught only to the students of computer department seeking degree in that subject, let alone its use at primary and secondary level. In universities the students of other subjects like sociology, languages, arts and other sciences are not taught the computer skills. This lags them far behind from students of other countries and few quality institutes of the country. Same is true of languages. English though introduced from primary level, is not taught according to the modern techniques of comprehension. Only reading lessons and knowing meaning of words cannot enable students to master the language. The methodology of English departments in universities is also in question. The national language, Urdu, is also not focused at any level of education. Learning of both these languages is important to produce capable and competitive students at the national and international level. The fate of the students of other subjects is also not much different. On the one hand, they are deprived of computer and language skills; on the other they do not become proficient in their field of interest as the proper methodology is not applied. Faculty members are not well qualified, research is not pursued and creative thought is ignored. These defects of our education system are the main reasons of the chaos, unemployment, poverty and social instability in our society. In order to overcome these shortcomings, we must adopt the liberal education system without any further delay. However, this requires a well thought out and comprehensive policy to improve the existing education system. Primarily, we should redesign our curriculum at all levels. All the major components/subjects of liberal education: sociology humanism, citizenship, history, philosophy, languages, computer and sciences must be introduced in every tier of education from primary to university levels in accordance with the capacity of students and the needs of society. Secondarily, all the institutions should be equipped with computer and scientific laboratories and libraries. The research and creative thinking should be encouraged through modern techniques of education. In this regard the accessibility and equality of all sections of our stratified society must be ensured in order to achieve uniform development. Lastly, the faculty must be energised by providing skilled and experienced teachers. The existing teachers should be trained to equip them with modern techniques of teaching methodology. Fresh and young blood must be encouraged to join education field as a profession by enhancing the monetary incentives in the education sector. This policy will yield tremendous benefits to the future of a nation. The liberal education is hailed because it brings concrete advantages. The young generation of Pakistan makes bulk of the population of country. According to a report of the State Bank of Pakistan 65 per cent of the educated youth is unemployed due to irrelevance of their skills with market. If this portion of population is properly skilled, it will prove to be a boost to the economy as the manpower is considered a resource in all countries of the world. Another benefit would be the eradication of poverty. Once our youth are employed, they will naturally add to the income of their families and consequently eradicate their poverty. It will also help in raising the living standard of our common man as it is directly proportional to the income of a family. The liberal education would create sense of understanding and cooperation among the people. The contemporary chaos of extremism and isolationism are due to lack of approach towards collective interests and common goals among people. Once they realise their social obligations and think creatively they will initiate participating positively in the stability of society. It is quite clearly manifested from the discussion that liberal education, which is the real education, is an essential component of good governance and stable society. It not only helps an individual to progressively achieve goals but also gives impetus to economic, political and social stability to a state. Unethical Practices And Conflicts Of Interest In The Pharmaceutical Industry As Healthcare Reform develops and shape regulations within the healthcare industry, unethical practices and conflicts of interest in the pharmaceutical industry affirm the need for transparency and improved traditions. Conflict of interest from a legal standpoint is a conflict between the private interests and the official or professional responsibilities of a person in a position of trust. (Merriam-Websters Dictionary of Law, 2010) From a business perspective, conflict of interest is defined as a situation that has the potential to undermine the impartiality of a person because of the possibility of a clash between the persons self-interest and professional-interest or personal-interest. (BusinessDictionary.com) With the number of physicians operating private practices in the United States, the clinical drug trial kickbacks have become common practice and the ravenous patterns have been explicitly revealed. The frequency of such behaviors and exposure of financial gain are enough to further strengthen the necessity for health care reform. Each unscrupulous circumstance that is exposed brings about further insight to the widespread unethical conduct of the pharmaceutical industry. There is an abundance of scenarios and examples depicting behaviors as well as emergent methods to circumvent such conflicts of interest. Additionally, laws and processes are in place to further develop and establish parameters around acceptable and unacceptable practices for both pharmaceutical manufacturers and physicians alike. When discussing conflict of interest as it relates to clinical drug trials the scenario is usually one in which a researcher has a monetary rapport and research money, with the company that manufacturers the drug being studied. There is nothing fundamentally erroneous with these types of conflicts of interest, they are practically everywhere within drug trials because most of the trials are financed by the drug companies that produce the drugs being studied. In an article written by John H. Montgomery related to the examination of conflicts of interest, research was done by Dr. Roy H. Perlis on the outcome of drug trials and the relationship that the author or industry has to that outcome. Research shows that 397 trials were reviewed and of those, 162 random trials yielded positive results that were funded by the manufacturer of the drug being studied. These results give indication that conflict of interest is common and associated to the outcome of the trials. This is just one of many examples of how common conflicts of interest arise in the healthcare industry. Another study conducted looked at randomized controlled trials of NSAIDs (non-steroidal anti-inflammatory drugs) between 1987 and 1990 (Bodenheimer). This study found that relatively all of the trials in the three-year span were sponsored by the drug producer. The research also discovered that the drug being compared to the manufactured drug was equivalent in efficiency and in s ome cases was even better than the manufactured drug in every trial. The study also reported that the manufacturer-associated drug was safer than the comparison drug in 86% of the trials (Bodenheimer). Remember, these trials were funded by the drug companies sponsoring the trials. How can conflicts of interest be avoided? First, when a patient is registered in a drug trial, full disclosure of any financial relationships with the drug manufacturer should be given. This builds trust with the patient and also fulfills the patients right to know this information so they can make the decision as to whether or not they want to participate in the study. Second, disclosure statements should be offered to the participant and ought to be clear and simple; this will often entice the patient to ask questions. Finally, research planners should be sufficiently familiar with any conflicts of interest with the investigator or the institution so that patients questions can be answered appropriately and correctly. Disclosure may not always be what most patients are looking for but the aforementioned suggestions could help satisfy the patient and trust the research process. He notes that an organized evaluation found 30 studies that investigated whether or not industry support is connected with results that are beneficial for the sponsor. The result: studies sponsored by drug companies were more than four times as likely to have outcomes favoring the funder, compared with studies with other sponsors (Goldacre). How can this partiality be allowed to take place? Perhaps it is the way the trials are planned. For instance, in some studies the opponent drug is given at an insufficient amount which raises the side effects of the drug. This in turn makes the supporters drug look more appealing. Another known issue is that there is no standard for communicating results of drug trials. The industry has the ability to print whatever they would like to report. More often than not, the negative results from clinical drug trials remain unavailable. The most alarming concern about the clinical drug trial process is that data is not only used once, in some cases data was published within the results of 14 other trials. It is inevitable that issues like this will exist in the industry when there is no formal standard by which clinical drug trials must adhere to. Though there is no standard set the FDA has published guidelines that the industry must follow regarding financial disclosure in drug trials. The FDA Guidance for Industry on Financial Disclosure by Clinical Investigators requires that anyone submitting an application to market a drug, product or device disclose any financial relationship or compensation received by all investigators involved in the trial being set up. The FDA specifies requirements about what information is required to be reported and lists actions that the agency will take if these requirements are not followed. The FDA should not be the only one addressing conflicts of interest in clinical drug trials though. Physicians should be attentive when participating in the trials or when treating a patient that is currently or is eligible to participate in one. Physicians participating in drug trials or enlisting patients for trials should be aware of the following guidelines: Physicians should only consent to participate in trials that are within their range of capability and practice and they should be appropriately trained in performing research. Physicians should be knowledgeable of ethics and should only participate in trials that they are convinced have been evaluated by a review board, the participants in the study are not at risk of being harmed, and that government policies are followed during the course of the study. If a physician is treating patients that are enrolled in a study or are eligible to participate in a study, they will need to make sure the patient understands that they treat them under both pretenses but as both physician and investigator. Physicians should make certain that procedure include stipulations that will support the participants health care should difficulty arise as a result of the trial. The nature and source of funding and financial incentives offered to the investigators must be disclosed to a potential participant as part of the informed consent process (Managing Conflicts of Interest in the Conduct of Clinical Trials). The physician should make certain that there is no impediment in the publication of the results of the study by the sponsor of the trial. Conflict of interest is a growing concern in the health care industry today. The issues are reported on the news and in publications more and more frequently. Bringing attention to the matter and raising awareness will aid in the development and improvement of ethics in clinical drug trials. An example of one of the reformation objectives would be eliminating the behavior of a physician who treats a patient suffering from dementia and later bills Medicare; however, this same physician does not report the adverse impact on the patient, because the physician has been promised adequate compensation for evading details and touting benefits of the drug. The patient filed a malpractice suit against the physician. The attorney during discovery learned that the plaintiff was enrolled in a study and did not meet the criteria to be included in the study. It was also discovered that the medical assistant did not have any experience or training in coordinating studies and were paid a fee for each person enrolled. The study was not in compliance or conducted in conjunction with the FDA statutes and regulations. The IRB which once approved the Protocol and Informed Consent halted the study eight months earlier. An additional $5,000 per month was paid to the physician for consulting se rvices. These same payments were paid to the physician under the Clinical Trial Agreement creating a duplication of services. Medicare was billed by the physician as well for the same items and services which including the drug that for formally paid out by the sponsor in which the physician has previously been reimbursed. The Plaintiff signed the informed consent alone without any counseling even though the sponsor knew the subject was diagnosed as suffering from dementia. Dr. Joseph L. Biederman, professor of psychiatry at Harvard Medical School and the chief of pediatric psychopharmacology at Harvards Massachusetts General Hospital poses a prime situation of drug payments going to physicians. Children as young as two years old are now being diagnosed with having bipolar disorder thanks largely to Dr. Biederman. Many of the children were treated with combinations of powerful drugs known as cocktails that were never approved by the Food and Drug Administration (FDA). The FDA must approve any children below the age of ten for any purpose in a drug study trial. Physicians may legally use only drugs that have been previously approved for a particular purpose or diagnosis, for any other purpose there must be upheld published scientific evidence before administering drugs. That was not the case for Biederman. His studies advocated the drugs that treated childhood bipolar disorder and was summarized by an article in The New York Times. Biederman was paid $1. 6 million in consulting and speaking fees from 2000 and 2007 including drugs that he advocated for childhood bipolar disorder. Similar amounts were paid two of his colleagues. The president of the Massachusetts General Hospital and the chairman of its physician organization apologized and express sympathy to its beneficiaries after the conflicts of interest were revealed. Chair of Stanfords psychiatry department and president-elect of the American Psychiatric Association Dr. Alan F. Schatzberg is another example of drug payments to physicians. Schatzberg controlled and co-founded Corcept Therapeutics in which he owned more than $6 million worth of stock. The company tested the drug Mifepristone, otherwise known as RU-486 the abortion drug as well as the drug used for the treatment of psychotic depression. Schatzberg, principal investigator on a National Institute of Mental Health grant that included research coauthored three papers on the subject of mifepriston. Schatzberg was later replaced as principal investigator to avoid a conflict of interest of misunderstanding. The most shocking case of drug payments to physician is that of Dr. Charles B. Nemeroff. Nemeroff, chair of Emory Universitys department of psychiatry along with Schatzberg, both served as coeditors of the influential Textbook of Psychopharmacology. Nemeroff served as principal investigator of the National Institute of Mental Health grant that was worth $3.95 million over five years. Emory University received $1.35 million which was used as overhead to study several drugs administered by GlaxoSmithKline. Emory University had to comply with government regulators along with the university to disclose income received from GlaxoSmithKline. Emory had to report any payments over $10,000 per year per the National Institutes of Health. This was done to ensure and eliminate the conflict of interest. Emory University compared records with GlaxoSmithKline and Nemeroff failed to disclose approximately $500,000 of speaking and consulting fees promoting the companys drugs. Emory conducted its own investigation in June 2004 and multiple violations of policies were founded on behalf Nemeroff. Nemeroff responded by issuing a memorandum at Emory stating he has been in compliance however GlaxoSmithKline reported paying Nemeroff a salary of $171,031. Nemeroff reported only $9,999 to Emory. He under reported by one dollar in which $10,000 is the threshold for reporting per the National Institutes of  Health. As a result of Health Care Reform which was passed in 2010 and initiated by President Barack Obamas administration, the Pew Prescription Project is an initiative of the Pew Charitable Trust promoting consumer safety through health care reform in the approval of manufacturing and marketing of prescription drugs. These initiatives will encourage or force evidence-based prescribing. The Pew Prescription Project conducts nonpartisan research through rigorous federal oversight in relation to drug safety. The purpose is to better illuminate problems and potential solutions in the area of prescription drugs. The Pew Prescription Act current goal includes the passage of the Physicians Payments Sunshine Act and the Independence Drug Education and Outreach Act. This includes improvements to current federal laws and regulations while improving FDA oversights and drug manufacturing. The advancement of evidence-based prescribing practices and ensuring clinical safety of drugs for children is another goal. The Physician Payments Sunshine Act has been passed within the current health care reform legislation. The provisions require drug and device companies to publicly report any gifts and payments that are made to doctors. The information must be posted on their web sites and reported to the US Department of Human Services. Companies can be fined starting at $10,000 up to $100,000. Many of the provisions must be fully operational starting in 2013. The government believes patients deserve and have the right to know if their doctors are receiving money from drug companies. Congress has added much needed transparency to the financial relationships between the pharmaceutical industry and physicians.   The reporting requirements in the health care legislation will better protect patients and will help restore trust in our health care system. This new legislation will enhance the safety of consumers by increasing transparency while in no way restricting business or limiting innovation. (Jewett) Though pharmaceutical marketing strategies has taken a new enlightened turn in the world of advertising, previous tactics of physicians actually promoting through accompanying pharmaceutical sales representatives has resulted in essential stimulated scrutiny. (Morreim) Many studies support that this kind of advertising has proven vital to the steady increase in pharmaceutical sales. So, perhaps physicians need to reexamine just how much they are persuaded by the irresistible allure of free fresh baked cookies or the tiny thin tubes that hold inks that we all know as a pen. Often a doctor is not going to prescribe medication that they barely know anything about; its the responsibility of the drug representative to educate the physicians on the name of the drug and drug facts so that they can then feel comfortable prescribing it to their patients. Drug representatives have basically been buying physicians time with whatever little inexpensive knick knack and kick-back it may take to get the name of the drug into the physicians brain and onto his prescription pad. Whats even worse is that most physicians will not give the drug representatives the time of day without some type of bribe or induction that is surprisingly not considered a kickback (in ter ms of legalities). A letter in the Journal of American Medical Association attests to just how intoxicating the advertising of the drug reps can be. The story describes a patient who came into the emergency room for an insect bite. The patient was originally seen by an intern who wanted to prescribe an inexpensive antibiotic, however the decision to prescribe the inexpensive antibiotic was overruled due to the fact that another resident recommended prescribing an new antibiotic that cost $183 per day. This incident was investigated by the attending physician who supervised the house officers and found out that this particular intern had recently wined and dined the day before by a drug rep from the manufacturer of the new expensive antibiotic prescribed. This type of behavior validates the enormous impact that marketing has on gifts of persuasion. In a story posted in the New York Times magazine, titled Dr. Drug Rep. a well respected physician Dr. Joseph Carlat shares his experience in being solicited by Wyeth Pharmaceutical Company to be a spokesperson for their drug Effexor XR, which is used for treating depression. They made him an enticing offer, and told him that all he would have to do is speak with his fellow colleagues about the features and benefits of the drug. Wyeth would provide all the information and materials that he needed to educate the other physicians about the drug and in return Dr. Carlat would be paid $500 for a one-hour training session or $750 if he had to drive for an hour. Dr. Carlat thought this would be easy enough. He was reputable; he had a busy private psychiatry practice specializing in psychopharmacology. He was quite familiar with drug Effexor and had read different studies pertaining to its effectiveness. The drug Effexor was being promoted by Wyeth as a dual reuptake inhibitor meaning that it increased both serotonin and norepinephrine, another neurotransmitter. The theory promoted by Wyeth was that two neurotransmitters were better than one, and that Effexor was more powerful and effective than S.S.R.I.s. (Carlat) Because he had already prescribed Effexor to several patients and it seemed to work, Dr. Carlat did not feel like there was anything unethical about him talking to other doctors about the drug. Dr. Carlat subsequently attended a full, expense paid physicians conference in Boston. When he began socializing at the conference there were other physicians functioning as spokespersons for other drugs and pharmaceutical companies. One physician that stood out was Dr. Michael Thase, the researcher who single-handedly put Effexor on the map. Thase presented evidence from clinical trials of Effexor being more effective than any other antidepressant. He rebutted criticisms of him being a paid consultant of Wyeth quite convincingly which was important. He explained to the attendees that he had requested and received complete information, both advantagess and disadvantages of the research data and not just the advantages. This was a significant point, because companies sometimes withhold negative data from publication in medical journals. For example, in 2004, GlaxoSmithKline was sued by Eliot Spitzer, who was then the New York attorney general, for suppressing relevant data that hinted Paxil caused suicidal thoughts in children. The company settled the case and agreed to make clinical-trial results public. (Carlat) Was I swallowing the message whole? Certainly not. I knew that this was hardly impartial medical education, and that we were being fed a marketing line. But when you are treated like the anointed, wined and dined in Manhattan and placed among the leaders of the field, you inevitably put some of your critical faculties on hold. I was truly impressed with Effexors remission numbers, and like any physician, I was hopeful that something new and different had been introduced to my quiver of therapeutic options. At the end of the last lecture, we were all handed envelopes as we left the conference room. Inside were checks for $750. It was time to enjoy ourselves in the city. (Carlat) However, after a year of pharmaceutical detailing Dr. Carlat became disturbed concerning feedback that Effexor caused hypertensions in a small but significant percentage of patients. For that reason, amongst other ethical reasons, Carlat decided to sever ties with Wyeth. Looking back on the year he spent speaking for Wyeth, he asked himself, Did I contribute to faulty medical decision making? Did my advice lead doctors to make inappropriate drug choices, and did their patients suffer needlessly? He admitted that there was a huge financial incentive for physicians to partner with pharmaceutical companies. (Carlat) Although he still allows drug reps to visit his office because it helps him stay abreast of the growing trends, he keeps the visits short and does not accept their offers and invitations. Who says this type of marketing isnt effective? Do other physicians really think they are invincible from the powers of persuasion? How many doctors actually engage in this type of marketing for drug companies? What role do ethics play in the decision to speak or not to speak on behalf of the insurance company? The truth is that previously many physicians engaged in this type of pharmaceutical detailing. While the median physician salary of 140,000 annually may be representative of a good salary, the additional $30,000 in supplemental income is quite alluring. In addition, to the monetary earnings earning respect based on reputation is important among colleagues. At least 25% of U.S. doctors are still receiving drug money for lecturing to physicians or assisting drug companies in other ways. Many physicians engage in this type of career appendage and perhaps go in with the purest of intentions; nonetheless, ethics are being violated when the physicians are not relaying accurate and appropriate information about the new medications that they are pushing, and much of the information that they are giving is provided to them from the pharmaceutical companies. PhRMA, Pharmaceutical Research and Medical Practices of America are part of an ongoing effort to ensure that pharmaceutical marketing organizations practice with the highest ethical standards. In January 2009, the voluntary PhRMA Code on Interactions with Healthcare Professionals took effect and its focus was developed to keep representatives from drug companies and healthcare professionals centered on patient care. It is committed to making sure that drug representatives are provided with the most current, accurate, and reliable information to assist in their decision making on drug selection. Companies are also asked to periodically access whether or not the representatives are abiding by the codes. (PhRMA) CEOs and Compliance Officers will have a process in place patterned after the Sarbanes Oxley compliance, other changes to the code reflects PhRMas support of transparency in relation to healthcare professionals. There is necessary education offered to interested parties regarding marketing techniques and physicians outlooks on pharmaceutical products, diagnoses and expected and proven outcomes. Since Pharmaceutical products must be marketed differently than other healtcare industry products for sale and there are distinct diversions for implementing successful marketing. The potential user or patient, must be granted a prescription from the prescribing physician. Proper use of the pharmaceutical is key which provides favorable or unfavorable outcomes. Though AdvaMeds Code of Ethics regulations do not mandate their guidelines be adhered to, health care organizations are strongly urged to utilize and enforce their codes can assist in eliminating and curtailing unethical behaviors that lead to lawsuits that actually develop in to Case Studies. As long as viable codes of ethics are followed, fear of transparency can be removed. Acceptably ethical behaviors will indeed help aid in the inevitable reformation efforts that this nation continues to experience.

Koran, So Long A Letter And The Symposium :: essays research papers

Many of these books took place in history a long time ago, although this is true they seem to be timeless. I have learned a great deal throughout all of the readings, and changed many of my feelings about several different issues. The books that had then most impacts on my thoughts were The Symposium, The Koran, The Apology, and So Long A Letter. These books have all made me fight the beliefs that I had prior to reading them, which is a sign of a strong book.   Ã‚  Ã‚  Ã‚  Ã‚  The Symposium was a unique book that had many stories and different books inside of it. This book either altered my views a small amount or change them drastically. There were many instances in the book that I didn’t know prior to reading it such as the title, which means a drinking party. One thing that I felt throughout life was that if you were in trouble, meaning a life or death situation, many people would die for you. My personal feeling was that this thought made sense, but after reading this book I realized that I might be mistaken. When I read that only a lover would die for you I started to realize that this might be true. The men in this time had lovers who were boys, or young men, and these lovers would die for their older lovers. The book also said that even a wife, although not as important as a lover would die for. After taking time to think this through, I realized that this might be the case, after all why would you want to risk your well b eing and life for someone you barely know. Maybe the only reason that you would die for someone was to be known as an honorable person, but to be honest, what does that truly matter when your dead?   Ã‚  Ã‚  Ã‚  Ã‚  The book also states that lovers will forgive for breaking vows. I didn’t feel that this could be true seeing is how there are so many divorces in this day of age, but I came to the realization that this is a false thought on my part and I do in fact concur with the books statement. The reason I believe this to be true is that if your lover (s) are truly your lover (s) than he or she cannot live without your love.

For the last few decades, gays and lesbians have come out and expressed their sexuality preferences. Many believe that same sex marriage should not be legalized because it's against the moral. It's against the definition of marriage, which is considered as the union of a man and a woman as a husband and wife. Same sex marriage should be legalized because the way society views the union of lesbian and gays can a change. Another reason why same sex marriage should be legalized is that children that are issued from a gay or lesbian couple will be loved and raised in a family that is legally recognized under the law. Lesbians and gays also deserve to have the same rights as heterosexuals.   Ã‚  Ã‚  Ã‚  Ã‚  The way society views same sex marriage can change. Throughout history, many beliefs have changed. In the past, black people were not considered as citizens in the constitution. It is not until the thirteenth amendment in 1865 that slavery was banned. Women were not considered equal to men and were not given the right to vote until 1920 when congress passed the fourteenth amendment. It takes time but opinions and beliefs can change and the past has shown us that is indeed possible! Same sex marriage are nothing more than the union of two humans being that care, love, and want to make commitments to each other. That commitment can not be recognized unless same sex marriage is legalized.   Ã‚  Ã‚  Ã‚  Ã‚  Prohibiting same sex marriage is unconstitutional. "The act discriminates on the basis of the sex by making the ability to marry depend on one's gender" (American Civil Liberties Union, p 12). It also disregards the Faith Full and Credit Clause of the constitution. If a gay or lesbian couple gets married in a state where same sex marriage is legal, but then for some reasons decides to move to another state where same sex marriage is prohibited, it would mean that their union would not be recognized.   Ã‚  Ã‚  Ã‚  Ã‚  Same sex marriage should be legalized. Gays and lesbians deserve to have the same rights in their unions as heterosexuals have. It is important to legalize same sex marriage because: Civil marriage is the way our society defines one's most intimate, committed relationships; it is the only vehicle our society has for recognizing the existence of primary relationships not defined by blood.

Rape Fantasies by Margaret Atwood :: Margaret Atwood Rape Fantasies Essays

Rape Fantasies by Margaret Atwood "Rape Fantasies" is written by Margaret Atwood in 1977. Basically this short story is about the narrator, named Estelle, recalling a conversation of several women during their lunch hour. It starts with one of Estelle's co-workers, asking the question 'How about it, girls, do you have rape fantasies?'(pg 72) The story goes on with each woman telling their supposed 'rape fantasy' to one another. As each is telling their fantasy, Estelle is doing her best to try to deflect the situation by making jokes about their fantasies. After all the women have told their fantasies, Estelle says, 'those aren't rape fantasies. I mean, you aren't getting raped, it's just some guy you haven't met formally who happens to be more attractive than Derek Cummins . . . and you have a good time. Rape is when they've got a knife or something and you don't want to.'(pg 74) Estelle then goes on to talk about her 'rape fantasies' from about to be raped by a short, ugly guy dieing from leukemia to squirting lem on juice in another attacker's eye.   Ã‚  Ã‚  Ã‚  Ã‚  I believe that her use of characters in the story was good. This type of story telling would seem typical to me for girls in an office setting. I don?t think that they would really talk about the fantasy of being forcible raped by telling their sex with a stranger type story instead. I also think that the point of view is important. Estelle is retelling the story through her view to someone else. She is probly at a bar or something, telling her story to some random man she met. I believe that she is trying to control a possible bad situation, maybe avoiding a rape, because she says in the last page ?..how could a fellow do that to a person he?s just had a long conversation with, once you let them know you?re human, your have a life too, I don?t see how they could go ahead with it, rights??(pg 78)   Ã‚  Ã‚  Ã‚  Ã‚  I actually enjoyed this short story. I really like the way Margaret Atwood laces the humor into her stories, like making fun the blond receptionist and the other blond, and how they compete with one anther.

With reference to the headscarf debate in France, analyze the extent to which laicite has played a major role in the French law 2004-228.

Introduction On March 15th, 2004 the government of French Republic passed a law that banned the wearing of â€Å"conspicuous signs† of religious affiliation in public schools (Bowen, 2007). Whilst this law affected Jewish skullcaps, large crosses, Sikh turbans, many scholars (i.e. Wing and Smith, Tarhan) believe that its main purpose was to ban the wearing of the headscarves, known also as hijab by young Muslim girls. Currently there are approximately 5 million Muslims living in France (CIA, 2012). The majority of them are the immigrants from former French colonies in North and West Africa. Muslims constitute 5-10% of the French population, while Islam is the second largest religion in France (Tarhan, 2011). Hence, the law from 2004 led to objections and protests amongst French Muslims. They regarded the decision of French government as a sign of discrimination and violation of religious freedom in France (Wing and Smith, 2006). French government, in turn, emphasized that French secularism (known also as laicite), assuming separation between state and religion, was a main reason standing behind its decision (Astier, 2004)). Until nowadays the French law 2004-228 is very controversial. The supporters of this law believe that a ban on religious symbols confirmed a secular character of French Republic and defended French national identity. They also postulate that a ban contributed to a greater equality amongst women and men within Muslim society. The opponents, in turn, emphasize a largely symbolic character of the ban, as it affected only Muslim girls attending public schools and did not apply to Muslim women on the streets or university students. The opponents often also rejected laicite as a basis of the French law 2004-228. Instead, they postulate that a fear of multiculturalism and growing division within the French society, especially after September 11th, had a key impact on the governmental decision (Scott, 2005). The following essay aims to examine whether French secularism, laicite, was a key factor responsible for the banning of headscarves in France. First, the essay explains the role of female headscarf in Muslim religion and tradition in order to understand a strong objection against a ban from Muslim side. Second, the essay presents shortly a debate on wearing headscarves in France that had its beginning in the 1980s. Further, the essay considers the concept of laicite in France and its impact on passing the French law 2004-228. The essay analyzes other factors that influenced on the banning of religious symbols in France in order to compare their role and the role of laicite in passing the law. Finally, the essay considers the ban as an unsuccessful reform and presents policy recommendations. The role of headscarf in Muslim tradition The headscarf[1] is an important religious symbol in the Islamic tradition. The Quran, perceived as the source of Allah’s command by Muslims, states that: â€Å"believing women (†¦) should lower their gaze and guard their modesty; that they should not display their beauty and ornaments except what must ordinarily appear thereof; that they should draw their veils over their bosoms and not display their beauty except to their husbands, their fathers, their husbands’ fathers, their sons, their husbands’ sons, their brothers, or their brothers’ sons or their sisters’ sons, or their women or the servants whom their right hands possess, or male servants free of physical needs, or small children who have no sense of the shame of sex, and that they should not strike their feet in order to draw attention to their hidden ornaments. And O you Believers, turn you all together towards Allah, that you may attain Bliss.† (Quran 24:31)Therefore, following Allah’s law, Muslim women are obligated to remain modest and to cover their beauty. Moreover, the Quran says: â€Å"O Prophet! Tell Thy wives And daughters, and the Believing women, that They should cast their Outer garments over Their Persons (when outside): That they should be known (As such) and not Molested† (Quran 33:59). It indicates that there are two purposes of the wearing of headscarves by Muslim women. First, headscarf should protect Muslim women from gazes of strange men and from being an object of stranger’s desire. Second, headscarf should help to distinguish Muslim women from women of other religions (Syed, 2001). It is worth adding that the Quran does not state precisely which parts of woman’s body should be covered. Hence, there are different types of head (and body) coverings amongst Muslim women in various countries, depending on Quran’s interpretation and culture. They range from the simple hijab, covering the head and neck to Afghani burqa, covering the entire body and leaving only so-called mesh screen so th at the woman is able to see (Wing and Smith, 2006). Further, the following sentence from the Quran: â€Å"O Prophet, tell your wives and daughters and the women of the believers to draw their cloaks close round them (when they go abroad). That will be better so that they may be recognized and not annoyed† (Wing and Smith, 2006, p.751) indicates that Muslim men are also obligated to Quran to make sure that their wives have got appropriate covering when they leave their houses. With the beginning of decolonization in the 1950s and the 1960s, the European countries, in particular France and the United Kingdom, had experienced massive immigrations from the Middle East and African countries. Most of the immigrants were Muslims. Hence, the Western countries, characterized by Christian roots had to face different religion, culture and values brought to the Europe by Muslims. Headscarf has become one of the most visible elements of these differences in the European’s public eyes (Wing and Smith, 2006). Headscarf debate in a contemporary France There are currently around 5 million of Muslims in France, constituting 5-10% of the total French population (CIA, 2012). Mostly they are immigrants from the regions such as the Maghreb, the Middle East, Turkey and Sub-Saharan Africa and Asia. Additionally there is an increasing number of people of European descent in France who are deciding to convert into Islam. In the recent years, Muslims in France has strongly manifested its cultural and religious separateness. They aimed to â€Å"create an Islamic identity with local institutional, societal and cultural structures† (Wing and Smith, 2006, p.753) and they focused on building new mosques and loud practices of their religion. It led to Islamophobic tendencies in France which were often manifested by hostility, discrimination in employment and housing as well as larger socio-economic exclusion of Muslim society. Currently Muslims continue to be separated from the rest of French society. Key indicators of this exclusion are li mited access to the education for Muslims, houses in the urban ghettos (known also as the zones of economic and social exclusion) but also lack of involvement in French political life and culture from the Muslim side. The debate on headscarves in France has got its root in 1989 and is known as the affaires de foulard (Scott, 2005, p. 1). At that time, three Muslim girls were expelled from their secondary state school in the town of Creil after they refused to take off their headscarves. Although it was not a first such a case (the director of this school had earlier banned Jewish students from wearing the Kippah in school), it brought an extensive attention of French media. The director of school argued that he made a decision on the basis of French laicite[2], a concept postulating separation between the state and religion (Tarhan, 2011). Muslim society was supported by Catholic, Protestant and Jewish leaders. Together, they postulated that laicite should have been regarded as toleration for other religions rather than condemnation of religion (Scott, 2005). This approach was also accepted by the former Minister of Education, Lionel Jospin. He announced that religious symbols and clothing at sch ools were allowed as long as they did not threaten other religious beliefs (Tarhan, 2011). Despite this governmental announcement, a number of similar cases has dramatically increased between 1989 (400 cases) and 1994 (3000 cases), what led to racial and religious violence in France (Bowen, 2007). In 1994 the tensions were so intense that education staff were sending letter to the French government, asking for advices on how to deal with the situation. In result, new Minister of Education, Francois Bayrou implemented new rules on religious symbols in schools. He allowed only discreet symbols in schools, while he prohibited ostentatious symbols. Discreet symbols were defined as those that â€Å"demonstrated personal religious conviction† (Tarhan, 2011, p.18), while ostentatious – as those that led to discrimination and differences into the educational communities. Bayrou’s claim was controversial and brought the attention of French media. In result, the Conseil d ’Etat, the highest administrative court in France, decided to investigate the controversial issue. The court rejected Bayrou’s decision and obligated school administrations and teachers to make decision on the actions of their students. The French government appointed a Muslim woman, Hanifa Cherifi, as a governmental mediator responsible for handling the wearing of headscarves. In result, the issue has grown quiet for nine years (Scott, 2005). The issue of headscarves was brought to the public attention again in 2003, when the Minister of Interiors and Cults, Nicolas Sarkozy postulated that Muslim women should take off their headscarves while posing for official identity photographs. As Muslims became an important minority in France with the beginning of the twenty first century, Sarkozy’s claim reflected growing frustration and intolerance towards visibility of religious symbols in public places amongst French politicians and society. It also brought back the issue of headscarves in schools. In effect, French President, Jacques Chirac formed a commission led by Bernard Stasi in order to investigate the implementation of laicite in French educational institutions. . Students, teachers, intellectuals and also the European Commission got involved in the work of Stasi’s Commission. Muslim girls chose to be interviewed undercover, as they wanted to voice their opinions about wearing the hijab anonymously. The report produced by Stasi’s Commission presented an in-depth study on the role that the hijab plays in the Muslim community. In reference to Islam, one of the most important results was that young Muslim girls, that used to grow up in a society dominated by western culture and values found difficult to reaffirm their identities as Muslims by the way they had to dress. Further, it showed that young Muslim girls were often not participating in classes such as P.E (physical education) as they were afraid of violence and assaults from Muslim men’s side. Moreover, Muslim girls often confessed that they were being forced to wear the hijab by their families and peer groups. The Stasi’s Report also drew open other issues su rrounding Muslim women such as female genital mutilation and forced marriages (Vaisse, 2004). The Stasi’s Report pointed out that the existence of religious symbols in schools was not compatible with the concept of laicite. The Report postulated that the veils were responsible for the alienation of women. As secularism and gender equality were regarded as the important features of laicite, the Report recommended banning religious symbols in schools[3] (Wing and Smith, 2006). It is important to add that the critics of the Stasi’s Report aimed to undermine the validity of the report. They postulated that the report was mainly based on western perceptions on the hijab and Muslim women. The link between forced marriages, female genital mutilation and the hijab, were all based upon the commission negative image of Islam, there was no empirical research to back their findings (Schiek and Lawson, 2011). Muslim women argue that the hijab is worn voluntarily and it brings them a sense of belonging and community (Schiek and Lawson, 2011). Following the Stasi’s Report, on February 10th, 2004, French National Assembly passed the law on the banning conspicuous religious symbols in schools. A huge majority of the Assembly, 494 members, were in favour of the ban, while only 36 members voted against the ban. At the same time, 31 members abstained from voting. Similarly, on March 3rd, 2004, the French Senate also passed the same legislation. 276 voters were in favour of the ban, while 20 of them voted against the ban (Weil, 2009). The implementation of the new law was preceded by three demonstrations, respectively, on December 21st, 2004; on January 17th, 2005; and on February 14th, 2005 that aimed to stop passing the law 2004-228. Mohammed Latreche, an Islamist activist mobilized and encouraged French citizens to participate in these demonstrations. He established a political party, Pati des msulman de France (the Party of French Muslims) with the headquarters in Strasburg. The demonstrations, showed the Muslim publ ics outrage at the law that was about to be passed. The legislative ban was regarded as an attack on Muslims with the Muslim society. Two girls even went as far as hunger strikes to show their opposition to the ban. Some posters propagated slangs such as ‘Stasi killed me’ and ‘1 veil= 1 vote’ (Bowen, 2007). Officially, the law was implemented on March 15th and it is known as the law 2004-228. Despite the demonstrations, the legislative ban in France has been largely supported by the French society. According to Pew Research Centre (2006) 78% of the French population have supported the ban, while only 22% of the population have regarded the banning as a bad idea. The concept of laicite and its impact on the banning of headscarves in France Many scholars (i.e. Wing and Smith, Scott) believe that the concept of laicite was a key factor behind the decision on the banning of headscarves in France. Laicite has a long tradition in France and hence, it is crucial to analyze its influence on the ban of religious symbols. As it was mentioned above, laicite, known also as a French secularism, postulates separation between the state and religion as well as freedom of religion (Tarhan, 2011). It can be viewed as passive neutrality or non-intervention by the state in the private religious domain. This interpretation suggests that the exercise of religion in the private sphere is permissible, and that the French state will not openly support overt religious practices in public spheres (Scott, 2005). Another interpretation of the laicite’ can be viewed as a more active secularism, in terms of which the nation is promoted as a fundamentally political society fiercely independent of any religious authority (Wing and Smith, 2006), and one in which the values of the state can be defended through the concept of Là ¢â‚¬â„¢ORDRE PUBLIC in order to justify interference where necessary with some religious organisations. This definition of laicite’ gives the government more control over public institutions and the amount of religious activity that goes on there, for example schools (Weil, 2009). The concept of laicite was developed during the French Revolution (1789). Initially it concerned the separation between the state and the Catholic Church, which played a major role in France in the seventeenth century. Revolutionaries aimed to redefine citizenship and nationhood and hence, to separate Catholicism from the French identity. New citizenship was meant to be universal, secular and inclusive. Instead, the French Revolution led to ‘xenophobic nationalism’ (Tarhan, 2011, p.4) which targeted foreigners as well as priests, rebels, political opponents and noblemen. Similarly, the Revolution started to reject religion rather than tolerate it. The laicisation of French public schools began with an article that was passed on June 28th, 1833. This law entailed that primary school teaching should have no religious affiliation. Further, laicite was implemented in France through the creation of the public school system, in the years 1881-2 with Jules Ferry’s public school laws (Bowen, 2007). However, despite these steps Catholicism remained an important element of French regime until the end of nineteenth century. More significant changes started in 1901 when France passed a new law, Law of Association according to which religious associations became obligated to have a state supervision. Further, in 1904 the religious communities were forbidden to provide education. In result, approximately 30,000 of clergy lost their teaching jobs and stopped taking salaries from the state. Nonetheless, the legislation passed in 1905, known as the Separation Act, is regarded as first meaningful success of secularists in France (Tarhan, 2011). The 1905 law has become the legal guideline for the separation of the state and the church. The word laicite did not appear in the 1905 law. However, the first article of the law emphasized freedom of religion in France, as it stated that: â€Å"the republic ensures freedom of conscience. It guarantees the free exerci se of religions with the sole restrictions decreed hereafter in the interest of public order† (Tarhan, 2011, p.7). The second article, in turn, declared that â€Å"The Republic does not recognize, fund or subsidize any religion. [†¦]State, departmental and commune budgets, together with all expenses relating to the exercise of religions will be abolished.† (Tarhan, 2011, p.7) and hence, it guaranteed state’s neutrality towards religions. The legislation from 1905 gave a political and legal character to the concept of laicite in France. More importantly, it indicated that laicite was a process that had emerged in France through the confrontation about national identity between Clerics and Republicans (Scott, 2005). Although the concept of laicite in France does not show any historical links to the Islam religion, the ban on religious symbols from 2004 seems to emphasize an impact of laicite on the French politics and tradition. Nowadays laicite is regarded in France as one of the foundations of French Republic and the French collective (national) identity (The Economist, 2004). It represents a sharp contrast to Anglo-American model of multiculturalism. French believe that laicite guarantees tolerance, freedom of religion, peace as well as social cohesion. Further, laicite postulates a sharp division between public and private spheres. Religion and ethnicity can be manifested in the private sphere. However, the only visible legitimate identity in the public sphere should be French national identity. Further, the laic state has right to interfere in the religious issues if the national unity and common values of the French Republic are threatened (Weil, 2009). According to the concept, Muslim soc iety should accept French norms and culture in order to become a part of French political unity. Nonetheless, Muslims have become a significant minority in France, unwilling to adopt French tradition and lifestyle. Instead, they strongly manifested own culture, tradition and identity (The Economist, 2004). Islam was perceived not only as a religion but also as a rigorous lifestyle that rejected Western values such as liberty, freedom and laicite. Muslims were often regarded as the extremist group. Hence, French started to perceive Muslims and Islam religion as the threads to the French national unity that had to be addressed and resolved. The debate on headscarves in France confirms this negative perception of Muslims within French society (Tarhan, 2011). With the exception of laicite, there were also other factors that had an influence on the ban of religious symbols in France. As stated in the Stasi’s Report, the ban aimed to empower Muslim women and to guarantee greater equality amongst the Muslim women and men. However, in this case, the ban was just a symbolic gesture, as it only applied to the young Muslim girls in public schools and did not affect adult Muslim women, working in some public places or just walking on the streets (Bowen, 2007). In contrast, there are several external factors that might have influenced the timing of headscarves debate in France. When the first debate on headscarves took place in 1989, the Communist system in the Central and Eastern Europe collapsed. Instead, the Europe experienced massive inflows of Muslim immigrants and spreading Islam religion across the European countries. Hence, Islam quickly started to be perceived as a thread to the Western values that replaced an old thread, communism . Further, in 1994 there was a civil war in Algeria, a former colony of France that was caused by the conflict between the secular military government of Algeria and Islamic fundamentalists. The Algerian conflict indicated a possibility of similar problems between the state and its largest religious minority in France. Finally, in 2003 the Europe was still strongly affected by the consequences of September 11th (2001). Additionally, the wars in Iraq and Afghanistan as well as the worsening of the conflict between Israel and Palestine resulted in sharp divergence between the West and Islam culture. At that time, French Muslims definitely identified with the Muslims in other parts of the world and the wearing of headscarves manifested such identification. French government, on the other hand, faced real threads of terrorism. Hence, the main principle of French defense became to prevent French citizens and institutions from potential challenges to their integrity (Scott, 2005). Conclusions To sum up, the ban of religious symbols in schools implemented in France in 2004 was very controversial and led to numerous protests and demonstrations in France. The supporters of the ban underlined the secular character of France and the need to separate religion from the public sector. The opponents, in turn, postulated a minor impact of the ban, as it only affected Muslim schoolgirls, constituting relatively insignificant percentage of Muslim female population in France. Without a doubt, laicite had a key impact on the legislative ban. However, the main factor behind the governmental decision was not separation between the religion and the state, regarded as a traditional element of the concept of laicite. In the contemporary France, key elements of laicite have become nation identity and unity. As the French society was characterized by a strong division on Muslims and non-Muslims as well as by strengthening Muslim influences, the French conservative government of Chirac has become responsible for protecting the French national identity. The ban was believed to be a successful tool to achieve this goal. Except laicite, there was a number of international events such as Afghan war, Iraqi war or Israeli-Palestinian conflict that strengthened Islamophobic in Western countries, in particular in secular France that has always been characterized by the opposition to multiculturalism and foreignness. Although some scholars postulate that gender equality wa s also a factor influencing French decision on the ban, there is no strong evidence to support this claim. In fact, the ban affected only small number of young Muslim girls being in public education. Nowadays it is certain that Muslims have to accept cosmopolitan values and freethinking if they aim to stay in the Western countries. Currently a number of Western countries such as United Kingdom, Spain or Germany have been characterized by a trap of two conflicting cultures. However, forcing Muslims to go against their religious practices, as applied in France seems to be counterproductive. The ban of religious symbols in France led to the riots (2005) in so-called les cites, ghettos focusing North Africans and Arabs that spread around the major French cities. During these riots two Muslim teenagers were accidently killed. However, the ban of religious symbols could have disastrous consequences. Young Muslims, rejected by the French government and regarded as a second-class society, often accept extremism and violence as the solution of their problems. The example of the United States demonstrates prominently the negative consequences of rejecting and underestimating its ethnic min ority. The young, radical Muslims in the US, trained by the conservative European imams became responsible for the dramatic events from September 11th (Kiersh, 2008). The French government should have learnt a lesson from the United States and should stop pushing its Muslim society towards extremism and encouraging violence amongst them. Instead, the French government should establish a long-term strategy in order to incorporate their Muslim minority into the environment they regard as unfriendly. The government must develop new, comprehensive measures that will help Muslims to identify with the rest of the French society and to become involved in various aspects of French lifestyle. In order to achieve these goals, the French government must focus on the reduction of job and housing discrimination in the first place as well as on changing the attitudes within the French policy towards Muslim male immigrants. The French government can expect that other European governments (in particular British, German and Spanish governments) will be also willing to address the problem of separation between Muslims and mainstream society, as they struggle with the same problem. Together, these countries have enough resources to implement reforms and changes so that the Muslims can assimilate with the rest of the societies. Also the United States could probably get involved in such a cross-countries program in the framework of the War on Terror. Without a doubt, the European governments would be more willing to accept such a form of terrorism fighting rather than military interventions in the Middle East. The following concept requires in-depth analyzes and detailed policy planning.
